The Tribunal has considered this case based on the papers provided by the parties, submissions given at the hearing and using its own knowledge and specialist expertise. … The Tribunal first considered the condition issues raised by the tenant. These were confirmed at the hearing and highlighted in the statement of case and evidenced with photographs. … The Tribunal finds that there is sufficient evidence to indicate that there was a significant vermin problem at the property. It is not clear whether this persists but the tenant did confirm that rats had been seen since May 2026. Notwithstanding, pest control investigations were instigated by the tenant rather than the landlord which suggests that the Landlord had not been proactive to resolve the problem. The Tribunal considers the rat infestation to be a very serious issue. No tenant or occupier should be expected to live in such an environment. Accordingly, the Tribunal is entitled to give it appropriate weight in its deliberations and assessment of rent. … The issue of damp and mould are evidenced by photographs in the applicants submission. We note that the Landlord is progressing the necessary inspections and maintenance works but the Tribunal has no further details as to the extent of these investigations or what works, if any, have been completed. …
