From the tribunal's valuation
Under section 14(1) of the Housing Act 1988 (as amended), the Tribunal is required to determine the rent at which the Property might reasonably be expected to let in the open market by a willing landlord at the beginning of the new period specified in the landlord’s notice. Relevant tenant improvements or failure of the tenant to comply with the terms of the tenancy are to be disregarded. Historic issues relating to the tenancy or the personal circumstances of the landlord are not taken into account. The personal circumstances of the tenant are only considered if an application for hardship has been made. … The Tribunal makes the determination on the physical nature of the property found, the tenant suggests two bedrooms, the landlord 4 bedrooms and the licence provisions apply for 5 persons showing two bedrooms on the ground floor and two on the first floor. … The Tribunal prefers “let agreed” comparables however there are none. The landlord provides a range of comparables which run from 2 bed above commercial premises to 4 bedrooms terraced. The tenant did not provide comparables. … The Tribunal discounts the properties that are not 3 or 4 bedrooms. A tenant clearly looking to take a four-bedroom house would expect to pay more that a three bedroom. The three-bedroom comparables range from £2100 to £2300. The only 4 bedroom is at £ 2496 pcm. …
