From the tribunal's reasons on the amount
This was a key issue at the hearing between the parties. The overall approach is set out in section 44 of the 2016 Act which specifies the factors that a Tribunal must take into account in making an RRO. … What proportion of the rent (after deduction as above) is a fair reflection of the seriousness of this offence? (iv) finally, consider whether any deduction from, or addition to, that figure should be made in the light of the other factors set out in section 44(4) of the 2016 Act, namely.: (a) the conduct of the landlord and the tenant (b) the financial circumstances of the landlord, and (c) whether the landlord has at any time been convicted of an offence identified in the table at section 45 of the 2016 Act. … The Respondent also sought to argue that he was not a “rogue landlord” against whom a RRO should be made at the higher end of the scale, but a landlord whose failure was to take sufficient steps to inform themselves of the regulatory requirements. … The total rent paid was agreed at £30,268.00. … Utilities – the only utilities provided by the Respondent were the supply of gas for heating and for cooking on cooker hob. Unusually the Respondent did not have to pay for heating separately as it was provided by a district heating system supplied by Camden and charged as part of his service charge. …
