From the tribunal's reasons on the amount
respect of a period must not exceed— (a)the rent paid in respect of that period, less (b)any relevant award of universal credit paid (to any person) in respect of rent under the tenancy during that period. … The respondent asserted the applicant has pleaded to matters long pre- dating the 12-month limitation period and that for the avoidance of doubt none of those activities pre-dating the 12-month limitation period contravene the 1977 Act nor give rise to a liability for a RRO. The respondent, in any event refuted all of the applicant’s allegations of harassment and unlawful eviction and told the tribunal the applicant had led the respondent to believe he did not wish to renew the tenancy and was leaving on or soon after the end of the contractual term. … The tribunal finds the applicant unequivocally led the respondent to believe he did not wish to renew the tenancy and intended to leave at the end of the contractual terms an informed the respondent of his intention to do so. … Consequently, the tribunal finds that at no time before he vacated the subject premises, did the applicant inform the respondent that he had changed his mind and was going to stay on as a statutory tenant. …
