From the tribunal's reasons on the amount
conduct of both landlord and tenant, the landlord’s financial circumstances and whether the landlord has been prosecuted. … The respondent provided no detail about his financial circumstances other than the fact that he owns 11 investment properties and that he is a respiratory consultant. He did not claim any financial difficulty. Nor is there any evidence that he has previously been prosecuted. … In relation to the respondent’s conduct, he has failed to either understand or comply with a landlord’s legal requirements under the HMO legislation. This is despite having been an owner of 11 investment properties, a history of 18 years as a landlord and his assertion of having been more “hands on” prior to the pandemic. All this demonstrates poor landlord management and poor conduct. In addition, he failed to protect the deposit, and there were no processes in place for fire safety in the property. … Whilst the relevant period falls within the period of the pandemic, that does not absolve a landlord from ensuring that he complies with the legal requirements put in place to ensure the tenants’ safety. His own oral evidence acknowledged that “safety comes first”. This was in contrast to his actions, or lack of them, during the relevant period as the applicants lived in the property for 12 months without a fire door to the kitchen. …
