From the tribunal's reasons on the amount

by the Applicant during this period (£3,635.69) leaving an amount to be claimed of £1,264.31. 14 As to the amount of the order, the Tribunal had regard to the following circumstances under section 44(4) of the Act. 15 The first Respondent is a professional landlord/property manager who should have been aware of the need to obtain a licence. Ignorance of the law is not a defence under the Act. 16 The Applicant’s evidence as to the state of the property has not been challenged by either Respondent. 17 Despite the issue of these proceedings it appears that neither Respondent has so far applied to the local authority to obtain a licence for the property. 18 It is not known whether the Council has instigated proceedings against either Respondent . 19 The Tribunal did not have details of the first Respondent’s financial circumstances but no plea of financial hardship has been made. The Applicant’s rent was inclusive of outgoings but no evidence of their amount or payments have been produced. 20 In circumstances where a professional landlord has not produced any evidence to validate expenditure and has demonstrated both ignorance of the applicable law and a reluctance to engage with these proceedings the Tribunal declines to deduct any further sums from the amounts claimed by the Applicant. …
