Insofar as the conduct was concerned, there were no convictions. It was suggested that with a TEN in place there was a defence and that the evidence we had showed that notice had been duly given under the provisions of section 72(4) of the 2004 Act. As the first application was made around 23rd December 2019 the period therefore stopped at that point and it was submitted continued until he received a decision on the notice.
