Introduction. The Tribunal have to be satisfied beyond a reasonable doubt that the Respondent has committed one of the relevant criminal offences. This is a high bar. As the Applicant has initiated the proceedings, it is her responsibility to provide evidence to satisfy us that the Respondent has committed each element of the criminal offence. It is not the Respondent’s responsibility to prove that he did not do something. … As the nature of the case is one of ‘he said/she said’, we need to assess the credibility of each party and look for corroborative evidence on matters of dispute. We are driven by evidence and not by someone’s belief, assumption or interpretation of matters. … It was not helpful that the parties’ bundles related to matters before the relevant period. … As the parties had previously been advised in Directions, in matters of dispute, the Tribunal attaches little weight to text threads without accompanying evidence such as a witness statement and the availability of a witness to be cross examined on the texts as there are difficulties in establishing dates and also whether the texts produced are a full and accurate representation rather than an excerpt or manipulation. …
