From the tribunal's valuation
Under section 14(1) of the Housing Act 1988 (as amended), the Tribunal is required to determine the rent at which the Property might reasonably be expected to let in the open market by a willing Landlord at the beginning of the new period specified in the Landlord’s notice. Relevant Tenant improvements or failure of the Tenant to comply with the terms of the tenancy are to be disregarded. Historic issues relating to the tenancy or the personal circumstances of the Landlord are not taken into account. The personal circumstances of the Tenant are only considered if an application for hardship has been made. … The Tribunal acknowledges the issues experienced by the tenant. Unsatisfactory drainage arrangements is a fundamental lack of amenity which must impact upon its suitability to be let and/or its rental value. It is recognised that this may not be a deliberate act or failure of the Landlord but nor is it the tenants responsibility. … The tenant cannot be held responsible unless there is improper or inappropriate use. … The Tribunal finds that, whilst the Landlord may not be culpable for the inadequacy of the drainage, he has not taken appropriate measures to remedy the problem having essentially let the tenant resolve it herself. …
