From the tribunal's valuation
The Tenant did raise the validity of the notice. However, validity relates to the notice meeting the requirements set out in the legislation, not the motivation for serving the notice. The notice did meet the requirements and the Tribunal considers it validly served. … All of the comparables evidence provided by the Tenant are relevant to this matter. … Relying on its own expert, general knowledge of rental values in the area, and the comparables provided by the Tenant, the Tribunal considers that the market rental for a room in a house share in this area to be in the range of £400 to £450 pcm. The room that is the subject of this decision is on the top floor of the property and, at approximately 3.5 metres by 4.5 metres, is at the larger end of rooms offered to rent. Therefore, we consider that market rent for this Property is £450 pcm. This is the rent we would expect the property to let for in the open market if it was in the same general condition as the comparable properties. … Whilst there are some maintenance issues in the bathroom and toilet, the Tribunal considered them to be of low significance and would not affect the market rent for the Property. Therefore, no deduction is made. Market rent £450.00 pcm
