From the tribunal's valuation
Having consideration of the evidence provided by the parties and our own expert, general knowledge of rental values in the NewBury Park area, we consider that the open market rent for the property in good lettable condition with modern fittings and services would be £2,200 per month. … The Tribunal received submissions from the tenant regarding the condition of the property, using its own expertise, the inspection and this evidence, we consider a significant of deduction of 50% should be made which equates to £1,100 per month should be applied to take into account the substantial tenants improvements to the property since 2020. Essentially, what you see in the property has been installed and provided by the tenant. Therefore, the Tribunal is place in the position to determine a rental value based upon the condition of the property without these significant improvements. This figure cannot be a simple arithmetical calculation and is not based on capital costs but is the Tribunal’s estimate of the amount by which the rent would need to be reduced to attract a tenant.
