From the tribunal's valuation
The Tribunal determines the rent by considering the rent at which the Property might reasonably be expected to be let on the open market by a willing landlord under an assured tenancy on the statutory assumptions. … The Tribunal accepts that the Property is a self-contained one-bedroom ground floor flat in a desirable part of Brighton and that it benefits from outside space. These are positive features likely to enhance rental value. … Whilst described as a generous one-bedroom property with a “top spec” kitchen, the Tribunal had no photographic evidence of the interior of the Property save for a single undated photograph of alleged mould in the corner of a room. … The Tribunal considers the comparables provided by the Tenant to be of limited relevance to this matter given they all describe two-bedroom properties. The Landlord had provided no comparables and relied upon the fact that the two prior tenancies of the Property had been let at £1,500 pcm. … The Tribunal does not place weight upon the parties’ assertions concerning alleged smoking, any anticipated court proceedings, the parties’ personal conduct towards one another, or the Landlord’s financial circumstances. Such matters are not relevant in assisting the Tribunal in determining open market rental value. …
