From the tribunal's valuation
The property advertised at £1,200pcm would appear to an outlier and as the only property with a higher rent does not support the proposed rent of £1,170 pcm. The rental submissions provided by the Tenant were at a lower rent and we queried whether these were adjoining properties or the same property advertised on two sites, but in any event we find that does not reflect the general market. … The Tribunal accepts that the Property benefits from gas central heating, double glazing and a garden and is situated within a modern residential development in Trowbridge. The photographic evidence demonstrates that it is generally habitable and maintained to a reasonable standard 22. Relying on its own expertise and general knowledge of rental values in the area, and the comparables provided by the Landlord and Tenant, the Tribunal considers that the market rental of the subject Property modernised and in good order would be in the order of £1,100 pcm. This is the rent we would expect the property to let for in the open market if it was in the same general condition as the comparable properties. … The Tribunal also accepts that a number of repairs and replacements have been undertaken only recently. … However, we do not make an adjustment for historic disrepair. … The Tribunal does not treat delayed repairs as equivalent to improvements. …
