From the tribunal's valuation
The Tribunal is required to determine the rent at which the subject property might reasonably be expected to be let in the open market by a willing Landlord under an assured tenancy. The personal circumstances of the Tenant are not relevant to this issue. … There has been reference to the condition of the property and the various improvements made by the Tenant. The landlord identified a list of works that are due to be undertaken but for the purpose of this valuation these have been ignored as they are not yet relevant. … In the first instance the Tribunal determined what rent the landlord could reasonably be expected to obtain for the property in the open market if it were let today on the terms and in the condition that is considered usual for such an open market letting. The Tribunal was assisted by the comparables submitted by the Tenant and the Landlord but we agree with the Landlord that it is difficult to make adjustments directly for the differences between other properties and the subject premises. We do not, however use RPI adjustments as rents are not directly related to general inflation measures and rent is not included in the basket of items used to calculate RPI. …
