The Tribunal determines a market rent for a property by reference to rental values generally and to the rental values for comparable properties in the locality in particular. It does not take into account the present rent and the period of time which that rent has been charged nor does it take into account the percentage increase which the proposed rent represents to the existing rent. In addition, the legislation makes it clear that the Tribunal cannot take into account the personal circumstances of either the landlord or the tenant. … The Tribunal assesses a rent for the Property as it is on the day of the hearing disregarding any improvements made by the tenant. … As neither the tenant nor the landlord produced letting details of any similar property, the Tribunal had to rely on their general knowledge and experience. … On this basis the Tribunal decision is that the rent at which the property might reasonably be expected to let in the open market is £93.00 per week. This excludes the service charge of £36.89 and any balancing from previous years accounts, which are not the subject of this application (they appear to have been agreed by the parties; if they have not, they could only be determined by the tribunal on a new application under section 27A of the Landlord and Tenant Act 1985). … This rent will take effect from 6 April 2020.
