The Tribunal notes that the original lease granted the Tenant the use of parking space No. … No documentation has been provided by either the Landlord or Tenant to demonstrate that this entitlement to the use of the allocated car parking space has been terminated. … The Tribunal has noted the provisions of paragraph 23 of Part E of the lease. However, section 5 (3) (e) of the 1985 Act provides that the terms of the original lease still apply on commencement of a periodic tenancy such that there is no reason not to assume, in the absence of any evidence to the contrary, that the Tenant still benefits from this space. … In this regard, damage to vehicles is a matter for insurance and is not a relevant matter to be taken into account in determining the market rent. … It is noted from the email correspondence provided to the Tribunal that the Landlord has complied with these obligations and offered compensation to the Tenant. The assessment of market rent assumes that the Landlord has complied with section 11 of the 1985 Act and the occurrence or otherwise of disrepair is not a relevant matter when assessing the market rent. … A failure by either Party to fully comply with their obligations is therefore disregarded in calculating the market rent. …
